Can AD9361 no-os driver work with Linux 2.6 kernel?

Our board has Altera Cyclone IV with NIOS2 software CPU. The NIOS2 Linux is pretty old (kernel is 2.6). We put AD9361 on board and I am trying to make NIOS2 to control AD9361.

 

Since our old NIOS2 2.6 kernel doesn't support device tree, I am focusing on NO-OS driver. After I checked AD9361 NO-OS driver. I found that it depends on UIO and SPI driver. Our NIOS2 2.6 kernel doesn't have UIO driver either. My question is:

 

Can AD9361 no-os driver work with Linux 2.6 kernel? Or, is it possible to make AD9361 no-os driver work with Linux 2.6 kernel (e.g. remove UIO...)?

 

If it's not going to work, I will have to upgrade our NIOS2 Linux kernel the latest 3.x to support device tree.
