Activity on SCK during the quiet time (t9) will affect the accuracy of the conversion. How much the accuracy will be affected is difficult to say. It depends on exactly when the activity occurs, the slew rate of the activity, processing and temperature.
The data sheet recommends a quiet time (t9) of 15ns before the rising edge of CONV.

The second waveform would be a violation of t9. The rising edge of SCK should occur at least 15ns before the rising edge of CONV.
