Question:
If MAX5085’s output is shorting to input with voltage ranging 35V to 39V.
1. Will the MAX5085 get damage?
2. If not, what will be the fault response?

Answers:
The output absolute maximum rating is up to (VIN + 0.3V) or 13.2V.
An output voltage exceeding 13.2V will damaged the IC. The MAX5085 does offer short circuit protection as well as thermal protection. What it does NOT protect against is an output over-voltage protection (in this case to the high voltage input power source) or overall current flowing into the device.
