You may use any frequencies that are part of the ISM bands without asking any permission or approval. ISM bands are license-free frequencies.
But, there are differences by countries. In the US for example, they are 315MHz, 915MHz…. while in Europe they are 433MHz, 868MHz.
The mentioned parts MAX1479 and MAX1470 operate below 500MHz; thus you have to consider either 315MHz or 433MHz
Now, this does not mean one can do anything in those frequencies. There are rules dictated in the standards (FCC, ETSI…). For example one cannot
transmit with an RF power at the antenna level of more than +10dBM. There are also rules on the bandwidth (for 433MHz, the window is approximatively 1.8MHz around 433.92MHz)
There are also requirements to channelize the band (that’s the case at 868MHz, but not at 433MHz), etc…
The final equipment will have to pass through the qualification/certification process before being able to sell it into the market.
