Although AD5060 and AD5040 are pin-compatible and uses the same SPI mode, it can't be directly interfaced using the same SPI sequence. AD5040 uses 16 clock cycles for data transmission (Figure 42) while AD5060 uses 24 clock cycles (Figure 41).

Thanks Ian! This makes sense. Our problem is that we cannot find AD5040 at any of our usual distributors (they say it's obsolete). We will need to redesign for the AD5060.

Sorry for the late reply. The AD5040 is at the "last time buy status". AD5060 can be used as a replacement but again, there needs to be some changes in the serial comm program.
